TERMS AND CONDITIONS:
Ballyphilip Parish Centre: conditions of hire
General
For private social events, the parish's insurance includes liability incurred by any persons hiring the premises in connection with the organisation of a private social event on no more than 3 occasions per hirer in a period of 12 months. The parish's insurance excludes the liability arising out of food and drink supplied at the event by a professional caterer, liability arising out of the use of inflatables, liability arising from bonfires and fireworks, liability arising out of any organised sports activities or liability arising out of any other activity of a hazardous nature. Cover for these liabilities is the responsibility of the hirer.
1. The hirer shall take out public liability insurance in respect of the function with cover of not less than £1 million with a good and reputable insurance office and shall not be entitled to access the premises until written confirmation of such insurance has been produced to the satisfaction of the parish’s insurance brokers. Such policy should include indemnity to the parish as principal and extend to include the act of any sub-contractor or exhibition that the hirer may have engaged. The parish and/or their insurance brokers reserve the right to inspect the full policy wording proposed prior to granting access to the premises.
2. The hirer shall fully and completely indemnify and keep indemnified the parish in respect of all claims (including for consequential and pure economic loss) for which they can be held legally liable by any person whatsoever (including sub-contractors) including death, or property caused by or in connection with or arising out of (whether directly or indirectly) the occupation or use of the premises, the equipment or the building and in respect of all costs and charges in connection therewith whether arising under statute or common law or otherwise.
3. All hirers of the premises must state the exact purpose for which it is required as described in page 1 above and the premises may not be used for any other purpose. The premises may not be used (save where the specific written consent of the select vestry has been granted) for any ballots, raffles, lotteries, palmistry or the promotion of any political party. The hirer must not be benefiting from any form of sponsorship from the alcohol or tobacco industry for the purposes of the hire of the premises. Decorations or hangings of any description may not be attached to any electrical fittings. No nails, sellotape, blu tack, tacks or fixtures may be driven into any woodwork, pillar, wall or any other fabric of the premises. No placard, name plate or other notice shall be affixed to any part of the buildings.
4. All necessary care of the premises and of the contents shall be taken and the hirer shall pay on demand the expenses of any breakages or damage or other loss in respect thereof whether accidental or otherwise. The hirer shall not part with the possession of the premises or any part thereof or the contents nor move any contents from the premises. At the end of the occupation the hirer shall render up the premises in a tidy and undamaged state and removing all the hirer’s own effects and belongings.
5. The hirer shall not permit to be done in the premises or the building anything which may reasonably cause annoyance to any occupiers of the building and neighbouring buildings. The hirer shall comply with all conditions, regulations and stipulations made or applying in respect of the premises by the fire authority, the local authority or otherwise, particularly in connection with any form of public entertainment and furthermore shall not do or permit or suffer to be done anything to injure the reputation of the parish or to offend against any statute, order, or regulation. In addition to the foregoing, the hirer shall at all times conform with all regulations which may from time to time be imposed by the parish in regard to the premises or the buildings and/or the contents and/or the other matters referred to herein.
6. The parish shall not be liable to the hirer or any other person for any loss of or damage to any goods or other things that the hirer or any other person causes to be in the building. The hirer shall permit the parish or its representatives or any other person on its behalf at any time or times to enter the premises for any reason or purpose.
Public performances and advertising
7. When the premises are being used for concerts or other entertainments, the hirer must first satisfy the parish regarding the objects to which the proceeds are to be devoted and in the case of meetings outside the control of the parish, the hirer must ensure that an adequate staff of stewards for control of the meeting will be engaged for the occasion, that the numbers admitted will be strictly limited to the seating capacity of the premises, and that, in the case of concerts, a list of artists taking part will be submitted to the parish for approval before publication and any works affected by copyright will only be performed if a licence has first been obtained from PPL PRS Ltd (www.pplprs.co.uk).
8. Programmes and all advertising matter for any meeting to be held on the premises must receive the approval of the select vestry prior to publication. The hirer must show the parish all decorations, hangings, placards, plates, displays, projections and any other forms of presentation to be placed on display and to seek the parish’s approval for all such decorations, hangings, placards, plates, displays, projections and any other forms of presentation before being placed on display at the premises
9. The parish reserves the right to call for a guarantee which they consider reasonable, prior to the acceptance of this hire. The parish reserves the right to refuse any application for the hire without assigning any reason and to cancel any hire already made should any of the terms be broken.
Safety
10. The hirer must comply with all directions of the caretaker of the building or the select vestry. The equipment for heating, lighting, and ventilation of the premises is under the absolute control of the select vestry and is not to be interfered with by anyone else.
11. The hirer must familiarise themselves with the fire and emergency regulations pertaining to the property, the emergency signal, and the assembly points to be used in the event of an emergency evacuation. They will also be responsible for ensuring that those attending a meeting or event in the property are informed of the hall hire agreement, the nature of the emergency signal, and the location of the emergency exits and assembly points. Smoking, beverages, and litter
12. Smoking is only permitted in the designated area. No alcoholic beverage may be sold, distributed, or consumed on or in the vicinity of the premises. Litter and other waste is to be placed in the receptacles provided for that purpose.
Safeguarding
13. The Parish of Ballyphilip & Ardquin adheres to Safeguarding Trust, the child and vulnerable persons protection policy of the Church of Ireland. The hirer is to make themselves aware of that policy, which may be found at www.ireland.anglican.org/information/160.
Miscellaneous
14. If the hirer wishes to cancel the booking before the date of the hire, the parish requires seven days’ written notice. The premises may not be sub-hired and the benefit of this agreement may not be assigned. If the hirer dies before the hire is due to commence the booking shall be deemed to have been cancelled.
15. The select vestry gives no warranty that the premises are legally or physically fit for any specific purpose. If the premises or any part thereof is rendered unfit for the use for which it has been hired, the parish shall not be held liable to the hirer for any resulting loss, damage or expense whatsoever.
